i've been booted off ebay for this very reason (owned by paypal), a few times.  its been the policy there forever.  its not that nintendo cares, they've pretty much abandoned the game boy line anyways.  but paypal conglomerate really does.  they are very quick to make sure they are playing by the rules. 

the possible solution would be to distribute LSDJ on OTP carts.  which sucks in so many ways but it at least makes the tech suitable to them.

But if I own a DMG, that doesnt mean I'm in the Wii market. They don't make carts anymore for my portable game thing. Once they stop supporting it, stop making money from it,  I think they should have to get out 'the way.

Actually even if they were profiting from it, we're just making our own hardware...they shouldn't have any control over that. It doesn't break any patents or copyrights.
